Covering Terms

The following terms cover the use of International Cat Care’s (“iCatCare”) services. By engaging with our services you agree to the following terms and conditions.

Information services

Diligence and care will be taken when using the information provided. All services are subject to copyright law. We use our best endeavours to ensure all information provided by us is as up to date as possible.

However, you should not rely on the information provided as the sole basis for making business, clinical, legal or other decisions. You should seek appropriate independent advice before making any such decisions. The content of all publications are the opinion of the author(s). In no event shall any losses (including but not limited to financial or standing) in whole or in part be borne by us.

Force Majeure

International Cat Care shall not be liable to the user for any non performance of its obligations by reason of matters beyond its control including, but not limited to, any act of terrorism, war, riot, civil commotion, compliance with any law or government order, fire, flood or storm, strikes, or any other industrial dispute, delay in transit, power failure, postal delay, or any event that cannot be reasonably be planned for or avoided.

In the event of Force Majeure we will continue our services as soon as reasonably possible.

Variation

International Cat Care may at any time revise these terms and conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the current terms and conditions to which you are bound.

Members may exit the contract without penalty if they do not accept any proposed variation.

Governing Law

These terms and conditions are governed by English law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based.

If any English court or competent authority decides that any of the provisions of these Terms and Conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

We will respond to any complaint or query received within five working days. This may be an acknowledgement that we have received a complaint whilst further investigations are carried out.

Interpretation

In this agreement the headings are used for convenience only and shall not affect its interpretation.

This agreement was written in English (UK). To the extent any translated version of this agreement conflicts with the English version, the English version Controls.

If any clauses are deemed illegal or otherwise unenforceable the remaining clauses shall remain valid. 

Website Terms

Your access to and the use of this site is subject to the following terms and conditions and all applicable laws. By accessing and browsing this site, you accept, without limitation or qualification, these terms and conditions and acknowledge that any other agreements between you and International Cat Care are superseded and of no force or effect.

  1. You may download, display or print information from this site (the “information”) solely for non-commercial personal use.
  2. You must retain and reproduce each and every copyright notice or other proprietary rights notice contained in any information you download. You may not, however, distribute, modify, transmit, reuse, repost, or use the content of the site for public or commercial purposes, including the text, images, audio, and video without written permission of International Cat Care. You should assume that everything you see or read on this site is copyrighted unless otherwise noted and may not be used except as provided in these terms and conditions or in the text on the site without the written permission of International Cat Care. International Cat Care neither warrants nor represents that your use of any materials displayed on the site will not infringe rights of third parties not owned by or affiliated with International Cat Care. There will be occasions where International Cat Care may use materials or images under licence or with the permission of a third party. International Cat Care does not warrant or give assurance that any such materials may be used by other parties without the express permission of the authorized copyright holder.
  3. No licence to or right in any copyright of International Cat Care or of any other party is granted or conferred to you.
  4. International Cat Care’s internet site may contain or reference trademarks, patents, proprietary information, technologies, products, processes or other proprietary rights of International Cat Care and/or other parties. No licence to or right in any such trademarks, patents, trade secrets, technologies, products, processes and other proprietary rights of International Cat Care and/or other parties is granted to or conferred upon you.
  5. While International Cat Care uses reasonable efforts to include accurate and up to date information in the site, International Cat Care makes no warranties or representations with respect to the content of the site, which is provided “as is”. International Cat Care accepts no responsibility or liability whatsoever arising from or in any way connected with the use of this site or its content. In particular, International Cat Care will not be liable for the accuracy, completeness, adequacy, timeliness, or comprehensiveness of the information contained on the site. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. International Cat Care also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the site or your downloading of any materials, data, text, images, video, or audio from the site. International Cat Care reserves the right to interrupt or discontinue any or all of the functionality of its site. International Cat Care accepts no responsibility or liability whatsoever for any interruption or discontinuance of any or all functionality of its site, whether the result of actions or omissions of an entity of International Cat Care, its divisions or any third party.

Any communication or material you transmit to the site by electronic mail or otherwise, including any data, questions, comments, suggestions or the like is, and will be treated as, nonconfidential and nonproprietary. Anything you transmit or post becomes the property of International Cat Care or its divisions and may be used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. International Cat Care will endeavour to treat any such communication within the scope of its published privacy policy. Furthermore, International Cat Care is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.
  7. The information may contain technical inaccuracies or typographical errors. International Cat Care reserves the right to make changes, corrections and/or improvements to the information, and to the products and programs described in such information, at any time without notice.
  8. Because International Cat Care has no control over and does not endorse any of the sites to which the site is linked and because International Cat Care has not reviewed any or all of the sites to which the site is linked, you acknowledge that International Cat Care is not responsible for the content of any off-site pages or any other sites linked to the site. Your linking to the site, off-site pages or other sites is at your own risk and without the permission of International Cat Care.
  9. Although International Cat Care may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on the site, International Cat Care is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the site. You are prohibited from posting or transmitting any unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. International Cat Care will fully cooperate with any law enforcement authorities or court order requesting or directing International Cat Care to disclose the identity of anyone posting any such information or materials.
  10. Links to this site are permitted only to the home page. Deep linking is not permitted without the prior written consent of International Cat Care.
  11. Framing of this site by sites or site elements of parties not part of International Cat Care is not permitted. In-line linking or any other manner of incorporating parts of this site in sites of parties not part of International Cat Care is equally prohibited.
  12. From time to time, new techniques may be developed by which third parties may, without authorization, utilize content, materials, images and other intellectual property from this site. Although the individual technique may not be described within these terms and conditions, International Cat Care expressly forbids such actions and declares that these are equally prohibited.

The Portal enables International Cat Care to monitor and track engagement by users with the resources provided. This information is used only for the measurement and improvement of the Charities services and mission.

Registration and Account Security

To ensure you have the best experience from our system you agree that;

The portal enables every user to have their own unique account on the system to access resources and purchase products as an individual.

The portal also enables you to set up a clinic account in addition to your personal account to allow you to manage a business account for purchasing and access to paid resources to multiple team members. Team members can be invited and managed directly in the portal. Any purchases made on the clinic account can be assigned by any member of the team.

Safety

To keep our community safe and to the standards we hold you accept the following commitments;

International Cat Care retains the right to terminate any users immediately without refund if they believe a user’s activities have breached any of the above commitments.

Professional Membership

When you submit your application on line, or telephone or email us with details of your application, you are making an offer to subscribe to our membership which, if accepted by us, will result in a legally binding contract.

At the point of renewal of your membership, your renewal payment is confirmation of the continued acceptance of this contract. You may not transfer any of your rights and obligations under these terms and conditions to another person.

If you are accepted into membership, but it subsequently turns out that any or all of the information provided by you was misleading or false, we reserve the right to revoke the membership with immediate effect, without the right of appeal or refund.

Payment

Access to our ISFM Vet membership is only available to professionals holding an active membership subscription.

We reserve the right not to fulfil, or to cancel, your application if we are unable to obtain payment authorisation from the issuer of your card or failure of an alternate payment method.

Payment for membership renewal is due by 23:59 on the day your membership expires to maintain continuous access to member benefits.

Clinic Membership

ISFM Clinic members are able to invite up to 5 qualified vets who work within their practice to ISFM’s online membership platform. Each vet must use a unique email address to create their account. If you would like to add more than 5 vets to your practice, please contact ISFM in advance for review.

Termination

We offer a seven working days’ cooling off period for new members starting from when your membership is activated.

This allows you to cancel your subscription without penalty. If you wish to cancel your new subscription, you must notify us within these seven working days in writing by email to support@icatcare.org.

Your membership is a rolling agreement which will automatically renew upon the anniversary of your acceptance. You will receive a renewal notice 7 days in advance of the anniversary of your application date, informing you of your entitlement to cancel and of any changes to your renewal fee.

You can cancel your automatic renewal at any point by visiting the subscription area of your Account or Clinic in the Portal.

Once renewal of your membership has occurred, it will still be possible to cancel your membership after the 7 day cooling off period, but we are not obliged to offer a refund.

Fees

Fees displayed on the application section of the website will prevail at all times.

We reserve the right to increase the price of the membership subscription on an annual basis. You will be informed of any fee increase within your renewal letter. If we discover an error in the price of your membership subscription, we will inform you as soon as is reasonably possible.

Event Terms

 These Delegate Booking Terms and Conditions (“T&C’s”) constitute a legally binding contract and our T&C’s take precedence over those of any other organisation in every case. These T&C’s apply to the booking of all events and congresses (the “Event”) hosted by International Cat Care ( “iCatCare”). By completing an Event booking you agree to these T&C’s. This contract is between the booking and/or attending party (the “Delegate”) and iCatCare. 

Payment, Cancellation and Transfers 

Payment for all events must be in pounds sterling. Your place at an event is only guaranteed on receipt of payment in full. In the event of payment by invoice places are guaranteed from allocation of the invoice payment, if all tickets are sold between invoice creation and allocation of payment iCatCare will refund the payment. 

Cancellations must be made in writing and will be subject to a £60 administration charge. Cancellations will only be accepted 30 days prior to the start of the Event. Cancellations made after this time will not be refunded. 

Name replacements will be accepted until 14 working days before the Event. The delegate badge provided is not transferable to any other party. 

Disclaimers 

Whilst the programme is correct at the time of going to press, iCatCare reserves the right to change details of the Event without notice. Alterations may occasionally be necessary due to circumstances beyond our control. 

All seats within a lecture are available on a first-come-first-served basis, iCatCare reserves the right to request a Delegate to change seats in exceptional circumstances. 

Where circumstances force iCatCare to cancel an Event or any part thereof, the liability of iCatCare shall be limited to a refund of any fees paid for that particular Event or part thereof. The Delegate agrees that the authority to cancel an Event rests exclusively with iCatCare and accepts its motives are fair and appropriate. 

iCatCare shall not be liable to the Delegate for any loss of profit or anticipated revenue, loss of time, loss of opportunities or for any indirect or consequential losses, however arising, and iCatCare’s total liability to you in respect of all losses shall not exceed the booking fee actually paid by the Delegate (providing that nothing in these T&C’s shall limit or exclude iCatCare’s liability for death or personal injury caused by its negligence). 

Views expressed by speakers are their own. iCatCare disclaims any liabilities for any advice given, or views expressed, by any speaker at the event or in any documentation provided to Delegates. 

Badge Information 

As a Delegate at an Event, you will be provided with a delegate badge. This badge will display your Name, Country and a barcode. The barcode, if scanned, checks eligibility into paid sessions and access to bookable functions. You are solely responsible for the safety and security of your delegate badge once it is handed to you. In order to allow entry to lectures and functions, your badge must be visible at all times or produced on request by an iCatCare representative. 

If you explicitly agree to be scanned by an exhibiter during the Event, this will provide additional contact information, (including full name, email address and country of residence) to the exhibitor. If you do not wish to be contacted, you can refuse for your badge to be scanned. iCatCare is not responsible for any data processing that is performed by the exhibitor with regards to your personal information once you have agreed to be scanned. iCatCare recommends that you check with the exhibitor the purpose or which your personal information is being processed before consenting to scanning. 

Photography and Filming 

Please be aware that a photographer and videographer may be commissioned to take photographs and videos during the Event. These photographs and videos may be included in iCatCare’s printed publications, via its website, circulated to the media or other interested parties in order to promote the Event, future Events and iCatCare. 

It is forbidden for Delegates to record audio or video within lectures, and Delegates must respect any direction on photographs by either the speaker or an iCatCare representative. 

Behaviour 

iCatCare retains the right to remove any Delegate whose behaviour is in breach of these T&C’s. Actions that disrupt the Event for other delegates, speakers or representatives of iCatCare are deemed a breach of contract by the Delegate. Decisions are at the discretion of iCatCare and are final. 

Miscellaneous 

These T&C’s in conjunction with the booking form constitute the entire contract between the parties and shall supersede all prior contracts and understandings, oral or written, between the parties relating to the Event.

Distance Education

Points 1 – 7 apply to both our Tutor-Supported and On-Demand course offerings:

  1. Payment.

    Payment must be made in full prior to beginning the course.

    For tutor-supported courses, this must be prior to the advertised start date. Places will not be held without payment. Details on how to access the course will only be provided once payment is received. Course places must be used and started within 12 months. After this time, unused course places will expire
  2. Payment via invoice (delayed payment)

    If choosing to pay via invoice, please ensure billing details are correct as these will be used to raise the invoice. Payment must be made in line with the terms on the invoice. Places will not be held without payment.
  3. Right to cancel.

    Our course materials and assessments are delivered via our learning platform in digital format. Where immediate access details are provided to a course, by logging into the Brightspace platform and therefore accessing the course materials, your right to cancel will be relinquished.

    A place on a course that has been assigned to a student is not transferable to another student unless the student has not accessed the course.

    Any refunds of course fees other than those covered by statutory consumer rights will be given at the discretion of International Cat Care.
  4. Technical support

    The Distance Education team at International Cat Care can provide limited support for technical or ICT issues via email but is not able to provide general IT support to learners.

    You must use the System Check available here – https://icatcare.brightspace.com/d2l/systemcheck to ensure the computer or device you will be using to study, meets the basic technical requirements need to access the course materials.

    Any support requests should be directed to courses@icatcare.org. Distance Education Department office hours are Mon – Fri, 9 am – 5 pm GMT. We aim to respond to your enquiry within 48 hours.
  5. Data collected in Brightspace

    Brightspace is the learning platform used to deliver our distance education courses. The learning platform collects data about your assignment submissions, assignment feedback, discussion posts, information about your visits to the course and grade information. This data will be used to: provide and facilitate course activities; support and administer your learning and progress through the course; analyse for reporting purposes to evaluate course design and improve its quality

    We will hold a record of your enrolment and final grade on completion of the course.
  6. Accessibility

    Brightspace is the learning platform used to deliver our distance education courses. Brightspace has been designed to be fully accessible. As web-based software, it complies with accessibility standards in that it is compliant with International web-access standards (VPAT and WCAC 2.0AA) and works with assistive technologies. If you have any issues using any parts of the course content, please get in touch as we’d be happy to discuss and make any arrangements or improvements to the course as necessary.
  7. Grades and Progress

    International Cat Care will only discuss progress and grading with students enrolled on their course. If the course is purchased by a third party, responsibility for providing updates on progress sit solely with the student.



    Points 8 – 11 apply to Tutor-Supported Courses only:
  8. Assessment and deadlinesAny deadlines provided for assessment at the start of the course must be adhered to in order to receive feedback and a grade from our external markers. If you have any queries or issues with the course schedule provided at the start of the course (detailing module release dates, assignment deadlines and grade release dates), you must notify the Learning Team as soon as possible and within the first 30 days of your course access so this can be discussed. If you miss an assignment deadline or fail to achieve the specified pass mark for a module you will have the opportunity to resit (a maximum total of 2 resits will be permissible per course).
  9. Extensions

    Extensions for a module deadline or to the course end date due to extenuating circumstances will be assessed on application. It is impossible to list all circumstances that would NOT be accepted as extenuating circumstances but some more obvious examples are personal disruptions or events which could have been anticipated; such as holidays, weddings, moving house, changing address or employment, religious holidays or festivals which are usually known in advance. Where possible, Extenuating Circumstance Requests should be submitted before a module deadline. If you have missed a deadline, you have 5 working days to apply for an extension.In extenuating circumstances, we may consider deferral to the next cohort. Places on the course can only be deferred for one year and on one occasion only.
  10. Transferring or delaying

    Transfers between courses, or intakes of a course, will be granted at the discretion of International Cat Care.
  11. Qualifications and accreditation

iCatCare courses are not reviewed, recognised and monitored by regulatory or professional bodies required to allow for official or professional accreditation.

Qualifications and accreditation of Feline Behaviour Courses 

iCatCare Feline Behaviour courses alone, do not provide the depth of training needed to allow students to refer to themselves as a cat or feline behaviourist. Our courses are however designed to complement other qualifications designed to teach someone to become a clinical animal behaviourist. In undertaking an iCatCare Feline Behaviour course, the learner accepts that the course is designed to enhance feline-specific behavioural knowledge and/or provides a solid foundation in feline behaviour to continue studying to become a qualified clinical animal behaviourist. The Feline Behaviour courses in no way accredit the learner to practice as a feline behaviourist.

International Cat Care reserve the right to contact any learners found to be advertising their services as a feline behaviourist as a direct result of completing the course. In these cases, International Cat Care reserve the right to ask for the removal of statements that make this direct link between the completion of the course and statements to practice as a feline behaviourist.
